Asked 1/18/2016 – El Paso, TX

I was caught shoplifting $16 worth of merchandise at a Texas Kohls. I received a letter from the law offices of Michael Ira Asen asking for $225. I have no priors, and have no attorney. I understand paying would put me on the national database, but that Kohls can take me to court whether or not I pay this.

Answer

There is a civil cause of action for merchants to sue shoplifters. In 34 years of practice, I have never heard of an actual suit of this mature being filed in Texas. I advise you not to pay this sum.
