Asked 9/1/2016 – Dallas, TX

Was pulled over and searched. Cops found hash oil that did not belong to me in a car that I had borrowed from my friend to drive home in. now I have a pending felony charge and don’t know what to do. Will the charge get dropped or lessened or something? A felony that is not my fault is not something I can just let ruin my life.

Answer

The charges against you will be “dropped” if the State cannot prove the allegations beyond a reasonable doubt. The key question is whether you were in either actual or constructive possession of the contraband. This is a fact issue; just because you state the drugs were not yours, does not mean a prosecutor, judge or jury will believe you. Start talking with local attorneys
