Asked 8/17/2016 – Greenville, TX

I received a class c misdemeanor for possession of paraphernalia and open container. I have yet to pay the fine since I just received it a few hours ago. Will this be on my record for future employers to see? Is there any way I can get this removed? I’m only 19, and I do not want this stupid mistake to ruin my future. Can this prevent me from obtaining a job in the future?

Answer

If you are found guilty, these matters WILL be on your record forever and can never be removed. These cases are not on your record yet. Just because you have been cited does not mean you are guilty of these offenses. You have the right to force the State to prove the allegations against you beyond a reasonable doubt, and before that point, you may be able to reach a plea bargain agreement that will avoid final convictions. Contact a local attorney and find out what your options are.
