Asked 4/20/2016 – Corpus Christi, TX

I am on pretrial probation for a felony dwi this is my first offense I have never been in trouble before and I violated my probation by being caught in a bar by a my ex-probation officer. Ex-Probation officer did not report to regular Probation officer until 10 days. Will he file a MTR also he asked me to go to do blood work SAMMC Lab and stated that he will report if I am negative but still going to tell judge. I did notify my lawyer so if MTR is filed is it best that I turn myself in

Whether a revocation is filed is discretionary with your probation officer. Stay in touch with your attorney, and, if you want to stay on the good side of the probation department, follow their instructions. I don’t know the exact conditions of your probation, so I don’t know if merely being in a bar is a violation, or if you are not allowed to consume alcohol as a condition of probation, or whatever. Have your attorney monitor if a revocation has been filed, then go from there.
