I got my second paraphernalia ticket a couple weeks ago (My first one I got November 2014). I had just smoked in my car and the cop smelled it and searched my car, all he found was a small bag with some weed crumbs in it. I am already on deferred adjudication because of multiple speeding tickets so getting this ticket was in violation of that. My court date is in two weeks.

Whether you will receive probation on your new case is totally discretionary with the Judge. If you are on deferred adjudication probation and are charged with a new offense while on probation, the deferred is subject to being revoked. If the probation is revoked, convictions will be reported to the DPS, which could cause the suspension of your driver’s license. You should definitely contact a local attorney before your court date to review the specifics of your case.
