Asked 8/15/2016 – Victoria, TX
So I am 17 yr old and I live in Texas. I really want to be emancipated because my parents treat me like I’m 5 and I feel as though I have been emotionally abused by them and my 19yr old sister. I’ve been called worthless, stupid, gross, the devil, discussing just to name a few. I have a part time job making 20k a year and I pay for all my food and clothing. I also am renting this house but I’m not living in it because my parents said if I leave the house they are calling the police. My question is: do I have a good chance of being emancipated? My parents would fight the emancipation. And if you could explain the process of getting emancipated and how long it takes I really appreciate it. Thanks in advance and God bless.
Answer
Emancipation requires a court order. A petition must be filed with the District Court where you reside, and your parents have the right to contest the matter. In Texas, you are considered an adult at 18. You can talk with a family law attorney in your area but if you are 17 and, depending on your birth date, I’m not sure you could finalize an emancipation proceeding before it becomes unnecessary.
