Asked 5/12/2016 – Houston, TX

My boyfriend is currently in jail serving 4 years. Possible parole at his 2 year mark next year in September. His questions: Is whether or not is case is aggravated or non aggravated. He had 2 drug cases nonviolent. One for marijuana was dropped so the only thing he is serving for is POSS CS PG1 4-200G PHENCYLIDINE. Would this case be considered non aggravated? We did not have a good state appointed or judge for that matter. Any help would be appreciated.

Answer

Drug cases are generally non-aggravated offenses unless there are other findings in the judgment, such as possession or delivery in a drug free zone, firearm, etc. If your bo6friend has already been given an estimated parole date, the type of offense and whether it is aggravated or not has been factored in calculating said date. You can probably go on-line, obtain a copy of the judgment and see if the offense was aggravated or not.
