1997 age 18 charged with theft of property while innocent and the female officer knew I was taking the blame for a friend who was found with stolen property in her stroller because of her baby and her telling me I better take all the blame was sentenced ti deferred adjudication completed in 1998. And terminated. It has never affected me however today came up when I had a credit protection company that I was told to sign up for from the government due to data breach. I am not a criminal and this was a class B however I am sure it would have at least been a C since the stolen goods where found in her stroller. This was 20 years ago in Texas. I have not lived in TX in 19 years and no longer a resident.

This is totally discretionary on your part. The caveat I would give you: you won’t know if failing to obtain an order of non-disclosure will hurt you until the situation comes up when it hurts you. Certain employers will perform background checks through 3rd party services who will automatically reject your resume if any criminal history appears. You may or may not be injured from the record of this incident without you knowing about it. If this credit protection agency saw this, a potential employer can see it, and theft is a crime of moral turpitude. Think of the non-disclosure as an insurance policy you would purchase to protect you from future harm.
